. >>> one group definitely profiting from the obama care mess, lawyers. the health plan is once again being dragged into court. correspondent shannon bream is here with that story. tell us about this latest challenge. >> reporter: today in federal court in washington this is a lawsuit about the text of an irs regulation stemming from the overall health care law. the plaintiffs in this case say the text of the law says those subsidies that go out to help people buy insurance are only supposed to be given out in states that have set up their own state exchanges and not into states where the federal government is the one operating the exchange. the irs says not. so according to the agency's interpretation those subsidies go to applicants in every state. that is a huge distinction. it's very important. because where the subsidies are awarded, that triggers massive costly mandates for the employers. they wouldn't have otherwise. that's why they're suing. they say the costs will force them to cut employee hours, stop hiring, maybe even go out of business. they say this is just another example of

the beginning of the obama care debate i've been telling you it's not the cost of the health insurance that will be the main problem. yes, the cost is going to go higher for working americans, no question, but it is access to doctors that will vex americans in the future. in the next five weeks millions of americans will be added to the medicaid rolls. next year the congressional budget office predicts that 9 million more people will be receiving medicaid. just 69 percent of american doctors accept medicaid now. that number may go lower as government payments drop. if millions are added to the medicaid rolls and two-thirds accept those patients, the lines are going to be all over the place. joining us from oklahoma city, dr. keith smith who has a surgery practice and dr. brooks. dr. brooks, you don't take medicaid health insurance at all, correct? >> that's correct, bill. >> why? >> i don't think i can do a thorough job. i don't believe in running people through my practice. i don't believe in volume practice and the new laws really would necessitate my pushing people through, not doin

to buy health insurance was kentucky, where the democratic governor of kentucky wholeheartedly embraced the whole idea of obama care, right, and who famously, the citizens of kentucky have reaped the benefit. kentucky now leads the nation in new sign-ups for health insurance, and that would be huge anywhere. it is a particularly huge deal for a state whose population is as unhealthful as kentucky's is. i don't mean any offense by it, but kentucky's population ranks at the bottom or toward the bottom of the nation's health ratings in lots and lots and lots of different categories, and kentucky has a lot of uninsured people. and it's the exact same deal two states over in mississippi, but in these two states, in the same part of the country, with the same health problems in their populations and a lot of the same challenges, one of them, kentucky, is now best in the nation in terms of people getting health insurance, and one of them, mississippi, is now worst in the nation, and not because they wouldn't know how to fix their problem. they knew how to fix their problem, but they stopped fi

coverage or health care. and the doctors on the back side of this obama care, when they're able to sign up, the medicaid dollars fall short, a lot of doctors are going to say i'm not getting reimbursed enough, i'm not taking those type of paints and you've got a whole other set of problems. the rhetoric the president is using now where he said most people will get better coverage and cheaper coverage, he's toned that down and saying there's a good chance you'll be able to do that. that doesn't help red state democrats in the 2014 midterms because they want some rhetoric they're going to be able to feed to people that undergird the promises they made when they parroted what obama said. so i think that's going to be a huge problem. if republicans continue to focus on the website, they're missing the bigger issue of coverage itself, which i think is much more difficult to handle than the website itself. >> but don't you worry about red state republicans like those in kentucky where the site is flourishing and those guys have been nothing but obstacles in trying to make an exchange, like kentu
